Yeah, that opinion is not good news for OC'ers. 

The court concluded that "openly carrying such a weapon (a semi-auto handgun) at that time (night) and place (urban residential area)" was sufficient to warrant a terry stop.

Of course by "openly carrying" what they REALLY meant was in his hand, but that's not stated in the court case, nor in the opinion.

And the other case where someone carrying a slung rifle is carrying it in an "assaultive" manner...  oh MY!

I bring out of that opinion that just so as long as it's plain a weapon is unloaded, painted bright orange, rendered inoperable, with a person dressed in a suit and near a pawn shop is ok.  Everything else isn't.

Frightening!

I am still in the process of drafting a letter to Rep. Sells and to let him know that I really wanted it to address an openly carried firearm that is secured in a holster instead of just a firearm being carried.

Honestly, I have a serious problem with them terming a slung rifle carry as "assaultive", since that implies you are committing "assault", which is absolutely not the case. Otherwise, every hunter walking in the woods with his rifle on his shoulder would be prosecuted for "assault" on any all of his hunting buddies. Pure stupidity, in my opinion.
